THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.28996 of 2018 Heard learned counsel for the petitioner and Sri V.Satyam Reddy, learned Standing Counsel for the second respondentMunicipality. Notice, bearing File No.A/234/1/2017-18, dated 23.07.2018, issued by the Commissioner, Karimnagar Municipal Corporationsecond respondent herein, is under challenge in the present Writ Petition.
The principal contention, advanced by the learned counsel for the petitioner, is that, without being issued by any show cause notice, the second respondent authorities issued the impugned notice asking the petitioner herein to vacate the leased premises. During the course of hearing, it is submitted by the learned Standing Counsel that the impugned notice may be directed to be treated as show cause notice and the petitioner herein may be given an opportunity to file an explanation and, thereafter, the respondent authorities will pass appropriate orders in accordance with law. The said statement is placed on record.
Recording the above submission, Writ Petition is disposed of, directing the petitioner herein to treat the impugned notice, dated 23.07.2018, as show cause notice, and to file explanation, within a period of two weeks from the date of receipt of a copy of this order, and, if any such explanation is filed, within the time stipulated above, the same be considered and appropriate orders be passed, strictly in
accordance with law. Till the said exercise attains finality, no coercive action shall be taken against the petitioner herein. Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
