THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.26315 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare inaction of the respondents 2 and 3 in receiving petitioner's complaint dt.12-08-2015 and inaction in not registering an FIR basing on the complaint and not investigating into the matter as illegal, arbitrary and contrary to the fundamental principles enshrined in the Constitution of India and consequently direct the 3rd respondent to receive the complaint lodged by the petitioner dt.12-08-2015 and register a crime basing on the complaint and investigate into the matter as per law."

Heard Sri N.V.R. Amarnath, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

Today, when the matter is called, written instructions, dated 08-09-2015 furnished by the Sub-Inspector of Police, Lalapet Police Station, Guntur Urban District have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is respectfully submitted that one Parlapalli Seshagiri Rao/the petitioner herein stated that he lodged complaint on 12-08-2015 with the respondent police against Shaik Mastan Vali/4th respondent herein the he sued to create litigation and grab the lands and houses of the innocent people and he also resort to settlements of the disputes. And he also harassing the petitioner repeatedly asking to sell his residential house to his henchmen, hence requested to take necessary action. It is further submitted that as of now the respondent police did not receive any complainant from the petitioner. As and when the petitioner approaches the Police Station for lodged complaint, the respondent police will take steps to register the case as per law."

On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 08-09-2015 furnished by the Sub-Inspector of Police, Lalapet Police Station, Guntur Urban District.
