HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No. 16247 of 2014 ORDER:

The petitioner, who is accused No.1, filed the present application under Section 437 and 439 Cr.P.C. seeking enlargement on bail in Crime No.249 of 2014 of Jangareddygudem Police Station, registered for an offence punishable under Section 302 IPC. The case of the prosecution is that the petitioner herein and two others killed one Nunna Venkata Subba Rao and took away the gold ornaments and cash etc. The said offence was alleged to have been committed with the help of accused Nos.2 and 3. Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State. The First Information Report which has been registered at the instance of one Nunna Pradeep Kumar Guptha discloses that on 15.06.2014 at about 11.00 p.m. the deceased went out for the purpose of purchasing provisions.

As the deceased failed to return home and since the informant could not reach his father on telephone, he immediately rushed to Jangareddygudem and started searching for his father. Ultimately, the body was found at Vegavaram road. The investigation done by the police discloses that the petitioner along with accused Nos.2 and 3 is alleged to have committed the offence. A perusal of the C.D. file which has been placed before the Court would show that the petitioner is involved in three cases which were registered for the offences of similar nature. The record further discloses recovery of property belonging to the deceased from the possession of the accused.

regard to the fact that the petitioner is involved in three cases of similar nature and in view of the apprehension expressed by the learned Public Prosecutor that there is every possibility of the petitioner evading the process of law in case if he is released on bail, the request of the petitioner is rejected.

However, the learned Magistrate concerned shall commit the case to the Court of Sessions at the earliest and the Sessions Judge concerned shall take all steps to dispose of the case as expeditiously as possible.
