HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29115 OF 2018 ORDER:

The present writ petition came to be filed seeking to declare the action of the 4th respondent- Tahsildar, in not receiving and processing the document submitted by the petitioner relating to the sale of agricultural lands admeasuring Ac.2.80 cents, situated at Sy.No.255-1, Ac.0.51 situated at Sy.No.345-1, Ac.0.51 cents situated at Sy.No.345-2, Ac.1.94 cents situated at Sy.No.331 and Ac.0.40 cents situated at Sy.No.256-2 of Rampuram Village, Penukonda Mandal, Anantapuramu District as illegal and arbitrary.

Learned Government Pleader for Revenue, on instructions, would submit that the petitioner has not even presented the document for registration and hence, the question of not receiving and processing the document for the subject lands, does not arise. He further submits that the subject lands fall under the prohibited list furnished by the Government and as such the petitioner is not entitled to seek any relief. However, she states that the respondents cannot prevent the petitioner from presenting the document for registration.

Having regard to the facts and circumstances of the case, the writ petition is disposed of permitting the petitioner to present the document for registration, within a period of two weeks from today before the 4th respondent, in such event, the 4th respondent shall process the same, if it is in accordance with law, within a period of two weeks thereafter. However, if the 4th respondent is not satisfied with the document presented by the petitioner, he shall return the same after hearing the petitioner and all the concerned, by assigning the valid reasons and communicate the same to the petitioner.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
