HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.5117 OF 2017 ORDER:
This writ petition is filed declaring the action of the respondents in not issuing pattadar passbook and title deed to the petitioner and trying to evict the petitioner from the land admeasuring Ac.2-92 cents in Sy.No.75/2, situated at Kummaripalem Village, Bheemunipatnam Mandal, Visakhapatnam District, as illegal and arbitrary. Learned Assistant Government Pleader for Revenue submits that petitioner has not made an application in proper format as envisaged under A.P. Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act'). Learned Standing counsel Sri S.Lakshminarayan Reddy, appearing for 3rd respondent submits that the subject land is mentioned as 'Vaagu' in the revenue records.
Learned counsel for the petitioner submits that petitioner will make necessary application in Form VI-A. In view of the same, the writ petition is disposed of granting liberty to the petitioner to make an application in Form VI-A and on such application being made by the petitioner, the 4th respondent is directed to pass appropriate orders in accordance with law after taking into consideration above facts.
With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
