THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13102 OF 2017 O R D E R :

The notice dated 23.12.2016 issued by the 2nd respondent Guntakal Municipality, whereby the petitioner was directed to remove the encroachments in her premises bearing No. 18-88-9-4, Guntakal Town, Anantapur District, has been challenged in this Writ Petition.

The case of the petitioner is that pursuant to the notice dated 23.12.2016, she personally met the 2nd respondent authorities and requested them to make a personal inspection of her house, as the notice did not specify the alleged projections, encroachments and obstructions, which ought to have been removed, but the authorities did not respond thereto. Heard learned counsel for the petitioner and Sri Mohd. Saleem, learned Standing Counsel for the 2nd respondent Municipality.

Since it is the case of the petitioner that she had personally met the 2nd respondent authorities and requested them to make a personal inspection of her house, but nobody has turned up, the 2nd respondent may depute the Site Engineer and get the site inspected physically, after issuing notice to the petitioner and to the extent required, necessary marking be made in her presence so as to enable the authorities concerned to remove the encroachments. Till the site inspection is made, no demolition shall be carried out by the respondent authorities. The Writ Petition is accordingly, disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall also stand disposed of.
