HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.29331 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondents 3 to 5 in calling the petitioner to police station and demanding balance amount of Rs.3.00 lakhs, without having valid reasons, as arbitrary and illegal.

Learned Assistant Government Pleader for Home appearing for the respondent-police produced written instructions, wherein it is stated that the petitioner was called for enquiry pursuant to registration of Crime No.22 of 2018, but he was not arrested nor detained in the police station. The allegation that the respondentpolice took Rs.1.00 lakh from the petitioner for his release is false. 3.

Learned counsel for the petitioner submits that the respondent-police are repeatedly calling the petitioner to police station and insisting the petitioner to pay the balance amount. 4.

In this case, it is to be seen that though the learned Assistant Government Pleader try to make some allegations against the petitioner, the same are not supported by written instructions. As per the written instructions, no crime is registered against the petitioner. In the absence of any crime registered against the petitioner, it is not known why the respondent-police are calling the petitioner to police station.

In view of the same, the Writ Petition is disposed of directing the police not to interfere with the life and liberty of the petitioner

and not pressurise the petitioner to pay amount and also not to interfere with the civil disputes, except in accordance with law.
