ORDER:
This Writ Petition is filed for a Mandamus to declare the inaction of respondent No.2 in considering representation, dated 18.9.2015, of the petitioner against the illegal and unauthorised construction of building by respondent No.3, as illegal and arbitrary.
At the hearing, there is no representation for the petitioner.
Mr. Md.Saleem, learned Standing Counsel for respondent No.2, on instructions, submitted that respondent No.3 has constructed a building without permission and that as the Building Penalization Scheme was in force till 31.10.2015, no action was taken anticipating making of an application by respondent No.3 for regularisation. That no such application has been filed by respondent No.3 so far, respondent No.2 shall initiate appropriate action according to law.
In the light of this submission of the learned Standing Counsel, respondent No.2 is directed to take appropriate action against respondent No.3 after notice to him and complete the process within two months from the date of receipt of a copy of this order.
Subject to the above direction, the Writ Petition is disposed of.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.44336 of 2015 shall stand disposed of as infructuous.
