When the matter is called, the learned counsel appearing for the parties brought to the notice of this Court that against the judgment in C.C.No.333 of 2002 dt.25.03.2008, the State has preferred appeal vide Crl.A.No.105 of 2008 on the file of the X Addl.District Judge, Wanaparthy and the said appeal is pending consideration.

The learned counsel for the petitioner seeks permission of this Court to withdraw this Criminal Revision Case with liberty to pursue the said appeal filed against the acquittal. Accordingly, the Criminal Revision Case is dismissed as withdrawn by giving liberty to the petitioner to pursue his remedy in Crl.A.No.105 of 2008 on the file of the X Addl.District Judge, Wanaparthy.
