2015-05-21K.C.Bhanu2 pages

THE HON'BLE SRI JUSTICE K.C. BHANU WRIT PETITION No.14386 of 2015 ORDER:

The relief sought in the Writ Petition is as follows: "...........declaring the action of the respondents in not disposing of representation of the petitioner dated 30.01.2015 and in not granting patta in respect of property to an extent of Ac.3.25 cents in Survey No.367/2 of Madhurawada Village, Visakhapatnam District as illegal, arbitrary, contrary to G.O.Ms.No.1745, Revenue Department, dated 25.08.1959, and consequently direct respondent No.3 to dispose of representation of the petitioner dated 30.01.2015 and to direct the respondents to issue pattadar pass book and title deed in favour of the petitioner in respect of land to an extent of Ac.3.25 cents in Survey No.367/2 of Madhurawada Village, Visakhapatnam District after causing enquiry."

Learned counsel for the petitioner contended that the petitioner derived title from her father, who was granted a patta by the Government. On the other hand, learned Assistant Government Pleader for Revenue contended that by producing a fake patta, the petitioner wants to mutate her name in the revenue records.

In view of the submission made by Assistant Government Pleader, I deem it appropriate to direct the third respondent to take appropriate decision on the representation of petitioner dated 30.01.2015 so as to mutate the name of the petitioner in the revenue records by duly taking note of the fact whether the patta granted in favour of the father of the petitioner is a genuine one or false one.

With the above directions, the Writ Petition is disposed of. Consequently, the miscellaneous applications, if any pending shall also stand disposed of. No order as to costs.
