Marri Jyothi, v. The District Collector,
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 30578 of 2012 ORDER:- The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not acting upon the representation dated 03.09.2012 made by the petitioners, as illegal and arbitrary. The grievance of the petitioners is that though they made a representation dated 03.09.2012 to the respondents seeking assignment of house sites, which are in their occupation, in Survey Nos.741/A and 741/B situated at Ursu Village, Warangal Revenue Mandal, Warangal District, till date no action has been taken.
When the matter was taken up for admission on 22.09.2015, there was no representation on behalf of the petitioners either in the morning session or in the afternoon session. Hence, the matter was directed to be listed today under the caption "for dismissal".
Even today, there is no representation on behalf of the petitioner. Hence, treated as heard and disposed of.
The learned Government Pleader for revenue appearing for the respondents submits that the request of the petitioners can be considered, provided the representation made by them is still pending consideration.
Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is
disposed of, directing the 2nd respondent to pass orders on the representation dated 03.09.2012 made by the petitioners if the same is still pending consideration, in accordance with law, at the earliest. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand dismissed.
