ORDER

This Writ Petition is filed seeking to declare the suspension order issued by the respondent vide proceedings dated 7.8.2015, as arbitrary and illegal. The petitioner joined in the respondent-Institute on 13.03.1995 as Watchman and subsequently, he was promoted as Store Assistant. While so, Memo dated 22.07.2015 was issued to him making certain allegations and he was called upon to submit his explanation, for which he submitted his explanation. Normally, this Court would not interfere with the order of suspension pending enquiry. However, in the present case vague and uncertain allegations were made against the petitioner, which could not be answered by the petitioner. As such, this Court is of the considered opinion that the suspension order is liable to be revoked.

Accordingly, Writ Petition is disposed of and the impugned suspension order is revoked. However, this order does not preclude the respondent to initiate disciplinary enquiry on specified charges and pass appropriate orders thereon. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall

stand closed.
