HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29179 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fourth respondent in not registering the partition deed dated 26.10.2017 presented on 26.10.2017, as illegal, arbitrary and violative of principles of natural justice.
2) Learned counsel for the petitioners mainly submits that though the petitioners gave a representation in the month of April, 2018, till date no steps are being taken for registration of the partition deed.
3) The Government Pleader, on oral instructions states that the properties which form part of the partition deed. are situated in Karnataka State and IN different parts of Andhra region, as such, there are many technical aspects, which are required to be dealt with before taking steps for registering the partition deed. She further states that if four months time is given, definitely the authorities would able to overcome all the technical issues involved, and register the partition deed after obtaining permission from the I.G. (Registration).
4) Having regard to the above, the Writ Petition is disposed of directing the fourth respondent to deal with the partition deed submitted by the petitioners for registration as expeditiously as
possible, preferably, within a period of four to five months from the date of receipt of a copy of the order, in accordance with law. 5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
