HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.35724 OF 2012 ORDER:

This petition is filed for a writ of Mandamus declaring the inaction of the 3rd respondent in engaging the services of the petitioner as Public Health Worker being successful tenderer as per the Tender Notification dated 04.06.2012, inspite of direction of the 2nd respondent in Rc.No.442/2012, A1(P), dated 11.07.2012 under para-5, to enforce tender process opened with reference to Item No.4 under the said notification, as illegal and arbitrary and for a consequential direction to the 3rd respondent to engage the services of the petitioner as Public Health Worker as directed the 2nd respondent as per the terms of the tender notification with reference to Item No.4 for a period of one year from the date of assignment of work.

This Court on 14.12.2012, while admitting the writ petition, granted interim direction.

Now, the respondents 1 and 2 filed counter stating that the Gram Panchayat has considered the tender filed by the petitioner when calling for applications for engaging persons as public health workers for the year 2013-2014 and allowed her to work as Public Health Worker on payment of Rs.6,000/- per month and she is continuing in the Grampanchayat as such as of now. In view of the aforesaid contention made in the counter affidavit, the cause in the writ petition does not survive for adjudication. As such, recording the said contention, the writ petition is disposed off. No order as to costs.

As a sequel to the dismissal of the writ petition, Interim Orders, if any passed, shall stand dissolved. _____________________________ A.RAJASHEKER REDDY, J 15.09.2015 tk
