THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.40202 of 2015 ORDER:

The petitioner prays for the following relief: ".......to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the 3rd respondent herein in initiating action under Section 4 of A.P. Assigned Land (Prohibition and Transfers) Act, 1977 (Act 9/77) read with Rule 3 of the Rules made there under with regard to evicting the unauthorized persons in respect of Sy.No.801/3 in an extent of Ac.1.32 cents situated at Kalavakuru village, Addanki Mandal, Prakasam District......."

Learned counsel, having regard to the stand taken in the counter-affidavit and also the scope of judicial review under Article 226 of Constitution of India, when the prayer is against inaction of respondents, does not press the writ prayer and seeks liberty to file petitions before respondent No.2-Revenue Divisional Officer, Ongole, Prakasam District, for all comprehensive reliefs i.e., interference by neighbours, etc., on the assignment granted to the petitioner. 3.

Respondent No.2 is, if such a petition is filed, directed to call for the record, register and pass appropriate orders as are warranted in this behalf.

Accordingly, writ petition is disposed of. No order as to costs.
