Learned counsel for the petitioner in this application fairly submits that in pursuance of the order dated 22.09.2023, passed by this Court in the Arbitration Application, Arbitral Tribunal has already been constituted and the first date of hearing is fixed tomorrow i.e., 23.12.2023.

In view of the aforesaid subsequent event, nothing survives for consideration in this interlocutory application and the same has become infructuous.

However, the petitioner in this application is at liberty to file counter before the Arbitral Tribunal, if so advised.

The interlocutory application is, accordingly, dismissed as infructuous.
