THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10089 of 2015 ORDER:
This Criminal Petition is filed by the petitioner - A2, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in PCOR No.463 of 2015-16 on the file of Prohibition & Excise Station, Jadcherla, registered for the offence under Rule 27(1) of A.P. Excise Rules.
Heard and perused the material available on record. The case of the prosecution is that in a raid conducted by the Excise police on 11.07.2015 at TCS Toddy shop, Papireddyguda, A1 was found in possession of 30 plastic cans and 12 bottles containing toddy and licence copy belonging to the petitioner was found in his possession and on enquiry, he stated that he was employed by the petitioner for selling the said toddy. Learned counsel for the petitioner submitted that the licence found in possession of A1 does not belong to the petitioner and only on the basis of the confession made by A1, the petitioner was made as an accused. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner.
In the circumstances, the petitioner - A2 is directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, she shall be released on bail on her executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. Further, the petitioner is directed to appear before the Station House Officer concerned, as and when required.
Accordingly, the Criminal Petition is allowed. ______________ RAJA ELANGO, J
