This Writ Petition is filed under Article 226 of the Constitution of India, for the following relief:

"To issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents 2 to 4 in identifying and taking steps to acquire the petitioners' lands situated in Yarramanchi, Gutturu, Munimadugu Villages of Penukonda Mandal, Anantapuram District by canceling the D.Form Pattas instead of taking steps under the provisions of "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013" is illegal, arbitrary, without jurisdiction and in violation of Principles of Natural justice and in violation of Art.14, 21 and 300- A of the Constitution of India and consequently direct the respondents not to proceed with the acquisition of the petitioners' land without following the procedure contemplated under "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013" in the interest of justice". 2.

Today, when the matter is taken up, it is submitted by the learned Advocate General that the lands situated in Gutturu and Munimadugu villages of Penukonda Mandal, Ananthapuram district are not required and the lands only in Yarramanchi village, Penukonda mandal, Ananthapuram district are required for Industrial Park. It is further submitted by the learned Advocate General that in fact the land owners have agreed to part with the lands subject to payment of compensation of Rs.10.50 lakhs per acre. It is further submitted by the learned Advocate General that if any land owners do not express their consent for the said settlement, procedure under Act 30 of 2013 would be followed and compensation would be paid accordingly.

Recording the said submissions, the writ petition is accordingly disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 11.4.2017 DA
