THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.20121 of 2016 ORDER:

Heard learned counsel appearing for both parties. With the consent of counsel appearing for both sides, the present Writ Petition is disposed of at the admission stage.

2. The present Writ Petition came to be filed with the following prayer: "Issue writ, order or direction one in the nature of Writ of Mandamus declaring the inaction of the 1st to 3rd Respondent in not initiating action in consideration with Petitioner's Complaint dt:10-06-2016 and 15-06-2016., is illegal and arbitrary, and contrary to law, and violation of fundamental rights and consequently direct the 1st to 3rd Respondents herein to demolish the illegal construction canned out by 4th Respondent at ground floor, 5th Floor and also restrain the 4th to 6th respondent from demolishing the existing lift at Diamond Apartment, bearing H.No.5-8-449, situated at Fateh Sultan Lane, Chirag Ali Lane, Abids, Hyd-1, in the interest of justice."

Though various grounds raised in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondent Nos.1 to 3 to take action on the complaints, dated 10.06.2016 and 15.06.2016 submitted by the petitioner with regard to illegal constructions made by respondents 4 to 6 in the property bearing H.No.5-8-449, Fateh Sultan Lane, Chirag Ali Lane, Abids, Hyderabad.

Having regard to the above and without going into the merits of the case, the Writ Petition is disposed of directing the 3rd respondent to pass appropriate orders on the complaint, dated 15.06.2016, said to have been made by the petitioner with regard to illegal constructions made by the unofficial respondents in accordance with law, as early as possible, preferably within a period of three (03) weeks from the date of receipt of a copy of this order after hearing the petitioner and the unofficial respondents. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
