HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6153 OF 2015 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 4th respondent Grampanchayat in proposing to conduct elections for Town Level Federation (TLF), which is under Mission for Elimination of Poverty in Municipal areas (MEPMA) of Tiruvuru Grampanchayat, Tiruvuru Village and Mandal of Krishna District, by removing the petitioners without any notice and without providing opportunity of being heard, as illegal and arbitrary and for a consequential direction to the 4th respondent not to conduct any election for TLF.

The case of the petitioners is that the 1st petitioner is the President and 2nd petitioner is the Secretary of Town Level Federation (TLF), which was established as a part of State level mission for Poverty in Municipal Areas. While so, a news item was published in a news paper stating that the 4th respondent has conducted a meeting and passed resolution on 02.03.2015 for removing the petitioners from the post of President and Secretary of TLF. The petitioners submit that without following due procedure as envisaged under Bye laws of the TLF, the respondents are trying to conduct elections by removing the petitioners. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioners.

Sri Nimmagadda Venkateswarlu, learned Standing Counsel for the 4th respondent, on instructions, submits that as on today petitioners were not removed and no resolution is passed. He also

states that since complaints were received regarding financial irregularities, a meeting was held. He further submits that as and when any action is being taken against the petitioners, procedure envisaged under bye-laws will be followed.

In view of the above facts and circumstances, I am of the view that the writ petition is premature and misconceived. Recording the above submission made by the learned Standing Counsel for the 4th respondent, the writ petition is closed. No order as to costs.

As a sequel there to, miscellaneous petitions, if any pending in the writ petition shall stand closed.
