Disciplinary proceedings were initiated against the petitioner vide charge memos dated 02.09.2014 and 15.06.2016. Petitioner filed her explanation to the said charge memos. Not satisfied with the explanation submitted by the petitioner, enquiry officer was appointed. While enquiry is in progress, according to learned counsel for the petitioner, the proceedings appointing the presenting officer were cancelled.

Learned Government Pleader for Social Welfare submits that there was change of enquiry officer and the same caused delay in concluding the disciplinary proceedings. However, learned Government Pleader is unable to state as to why enquiry could not be taken up by the enquiry officer though sufficient time was granted.

Having regard to the said submissions, without entering into the merits of the case, the Writ Petition is disposed of directing the respondents to conclude the disciplinary proceedings against the petitioner as expeditiously as possible, at any rate within three months from the date of receipt of a copy of the order, in two separate proceedings, as the charges relate to the years 2014 and 2016 and for no fault of the petitioner, they were kept pending so long. While granting time to complete the disciplinary proceedings, the respondents are also directed to consider the case of the

petitioner for promotion to the post of District Scheduled Castes Development Officer, if the disciplinary proceedings are not concluded within the time granted and not attributable to the petitioner. Pending Miscellaneous Petitions, if any, shall stand closed.
