The present Criminal Petition came to be filed under Sections 437 and 439 Cr.P.C., by the petitioner/A.1, seeking enlargement on bail in connection with Crime No.51 of 2016 of Cumbum police station, Prakasam District registered against him and others for the offences punishable under Sections 376, 323, 506 IPC and 6 of the Protection of Children from Sexual Offences Act, 2012. 2.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

It is brought to the notice of this Court that by an order dated 18.08.2016 in Criminal Petition No.12028 of 2016, this Court dismissed the bail application filed by the petitioner. Learned counsel for the petitioner states that police completed the investigation and filed charge sheet, which, after committal, came to be numbered s Sessions Case No.94 of 2016. He further submits that all the other accused are released on bail. That being the position, the petitioner is at liberty to move application before the trial Court seeking bail, in which the same shall be considered in accordance with law uninfluenced by observations made in the earlier order of this Court. 4.
