HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.303 of 2017 ORDER :

This criminal petition is filed to relax the condition imposed by the Metropolitan Sessions Judge-cum-Special Judge to Try the Offences Under NDPS Act, Visakhapatnam, while releasing the petitioner/A.1 on bail for the offence punishable under Section 20(b) of NDPS Act in Crime No.51 of 2016 of Arakuvalley Town Police Station, directed the petitioner to execute a personal bond for a sum of Rs.10,000/- with two Government Sureties, one from the native place of the petitioner and one surety from Visakhapatnam, for like sum, each to the satisfaction of Judicial First Class Magistrate, Araku, and also directed to furnish the attested copies of Aadhar Card, Voter ID, Ration Card, if any, subject to verification of genuineness he shall be released with other normal conditions.

Now, the contention of the petitioner is that the petitioner is from a tribal area, who is not in a position to furnish two Government servants as sureties, one from native place of the petitioner and one surety from Visakhapatnam.

The total quantity of contraband involved in the offence is 8 kgs. against this petitioner. By taking into consideration of the quantum of contraband, the condition of petitioner to execute a personal bond for a sum of Rs.10,000/- with two Government servants as Sureties, one from the native place of the petitioner and

one surety from Visakhapatnam, of like sum each to the satisfaction of Judicial First Class Magistrate, Araku, is only modified to that of, the petitioner shall execute a person bond for Rs.10,000/- with sureties each for the like sum, of which, one surety shall be from Visakhapatnam.
