THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY I.A. No.1 of 2018 IN / AND APPEAL SUIT No.731 of 2003 JUDGMENT:

This appeal is filed by the plaintiff, under Section 96 of CPC, assailing the decree and judgment dated 17.3.2003 passed in O.S. No.77 of 1993 on the file of the Court of Principal Junior Civil Judge, Rajahmundry.

Pending appeal, the plaintiff died and his legal representatives were brought on record as appellant Nos.2 and 3. During the pendency of the appeal, the Airport Authority acquired an extent of Acs.4.20 cents of land out of Acs.11.14 cents of the suit schedule property. 3.

The appellant Nos.2 and 3 and the respondent appeared before this Court. Sri S.Sridhar, learned counsel identified the appellant Nos.2 and 3. Sri P.Rajesh Babu, learned counsel identified the respondent. I.A. No.1 of 2018 is filed by the petitioners-appellant Nos.2 and 3 to permit them to compromise the matter with the respondent in terms of the Memorandum of compromise.

Heard the learned counsel for both the parties and perused the record. This Court read over and explained conditions (i) to (vii) of the Memorandum of Compromise to appellant Nos.2 and 3 and respondent in Telugu and they

admitted the same. The appellant Nos.2 and 3 and respondent, in the open Court, submitted that they entered into compromise to put an end to the long drawn litigation at the advice of the elders.

Accordingly, I.A. No.1 of 2018 is allowed. Consequently, the appeal is disposed of, in terms of the compromise. Miscellaneous petitions, if any, pending in this appeal shall stand closed.
