THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL REVISION PETITION No.4689 of 2011 ORDER:

The petitioner herein is the plaintiff in O.S. No.65/2009 on the file of the Court of the learned Junior Civil Jude, Rajam. The said suit was filed for permanent injunction restraining the defendants from interfering with the peaceful possession and enjoyment of the plaint schedule wet land admeasuring Ac.0.50 cents situated in Saradhi Village, Rajam Mandal, Srikakulam District. Along with the suit, the petitioner herein filed I.A.No.304/2009, and temporary injunction was granted by order dated 19.10.2009.

Against the same, the respondents herein preferred C.M.A. No.10/2009 before the Court of the learned Senior Civil Judge, Rajam, and the same was disposed of on 29.07.2011 modifying the temporary injunction to that of status quo obtaining as on 06.11.2009. The said order has been in operation for the last four years. Against the same, the present Civil Revision Petition was filed.

Since the suit itself is for permanent injunction, this Court is not inclined to interfere with the said order, and without expressing any opinion on merits, the learned Junior Civil Jude, Rajam, is directed to dispose of O.S. No.65/2009 as expeditiously as possible, but not later than 30.04.2016, after giving due opportunity to both the parties.

Accordingly, this Civil Revision Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Civil Revision Petition shall stand closed.
