HON'BLE SRI JUSTICE S.V.BHATT C.R.P. No.331 OF 2017 ORDER:

Heard Mr.R.Siva Sai Swaroop for revision petitioners. The petitioners pray for disposing of E.A. No.484 of 2016 within reasonable time. The 1st respondent filed E.P. No.498 of 2015 putting to execution the decree and the judgment in O.S. No.177 of 2013. The case of petitioners is that the decree dated 06.11.2015 is ex parte decree. The learned Principal Senior Civil Judge, Kurnoool, before whom the application is pending, is not disposing I.A. No.1154 of 2016. While matters stood thus, the E.P. is filed before the Additional Senior Civil Judge, Kurnool and the petitioners filed E.A. No.484 of 2016 to stay execution of the decree and the judgment in O.S. No.177 of 2013, for I.A. No.1154 of 2016 is still pending. This Court is of the view that the disposal of I.A. No.

1154 of 2016 enables the petitioners to understand where they stand vis-à-vis the execution in E.P. No.498 of 2015. Though the prayer in the C.R.P. is to direct expeditious disposal of E.A. No.484 of 2016, with a view to give quietus to uncertainty and for expeditious disposal of interlocutory application, I deem it appropriate to direct the learned Additional Senior Civil Judge, Kurnool to hear and dispose of I.A. No.1154 of 2016 within four weeks from the date of receipt of a copy of this order. The petitioners are given liberty to file the order in this C.R.P. before the Court of Senior Civil Judge, Kurnool along with a memo, within one week from today for disposal of I.A. No.1154 of 2016 as directed in this order.

The C.R.P. is disposed of accordingly. No order as to costs. Miscellaneous petitions pending, if any, shall stand closed. ___________ S.V.BHATT,J Date: 01.02.2017 Stp
