HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29030 OF 2018 ORDER:
The present writ petition came to be filed seeking to declare the action of the 3rd respondent-R.D.O, in not disposing off the appeal filed by the petitioners in Rc.No.279/2018-C, seeking cancellation of pattadar passbook and title deed issued in favour of the 5th respondent, basing on the factual report submitted by the Village Revenue Officer, Polepally Village, Durgi Mandal, Guntur District, and adjourning the appeal from time to time, as illegal and arbitrary.
When the matter is taken up for hearing, learned Government Pleader for Revenue, placed on record, the written instructions, wherein it is stated that the report of the Tahsildar, Durgi, was examined and notices were issued to both the petitioners and respondents under A.P. R.O.R Act and the case is posted to 1.9.2018 for hearing and filing of any depositions in the matter and final orders will be passed as per the provisions of the A.P.Pattadar Passbooks Act, 1971 and 1989. Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the 3rd respondent-R.D.O, to dispose of the appeal in Rc.No.279/2018-C, filed by the petitioners, in accordance with law, as early as possible, preferably within a period of two to four months from today, by giving reasonable opportunity of hearing to the petitioners and all the concerned. Till such time, status quo existing as on today with regard to the entries in the revenue records, shall be maintained.
With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
