THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34089 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in threatening the petitioner and her son to vacate the subject premises and consequently to direct the third respondent not to vacate the petitioner forcibly from the house No.4-17-32/1, Mahmood Nagar, Hasan Nagar, Rajendranagar, Ranga Reddy District.

Heard and perused the material.

Learned counsel for the petitioner submits that the third respondent is interfering in the civil dispute between the petitioner and the fourth respondent and as such, prays this Court to direct the third respondent not to interfere in the civil dispute and also to direct him not to forcibly vacate the petitioner from the premises stated above. Learned Assistant Government Pleader for Home (Telangana) submits that the third respondent is not interfering with the civil disputes, and more particularly, the civil dispute between the petitioner and the fourth respondent.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the third respondent not to interfere with the civil dispute between the petitioner and the fourth respondent and he is further directed to follow the due process of law laid down in Code of Criminal Procedure. However, it is made clear that this Order will not stand in the way of any investigation, if any case is registered against the petitioner for commission of any cognizable offence.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 17.10.2016 pln
