THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.37872 of 2016 ORDER :

Apprehending that the petitioners properties are going to be demolished and trying to interfere with their peaceful possession and enjoyment by the respondents, this writ petition is filed. 2.

When the matter is taken up, learned Standing counsel would fairly submit that no such action was taken and the Corporation would follow due process before effecting any demolition. He would further submit that the Corporation will not interfere with the private property of the petitioners whereas it would only take action for any illegal activity that is going on in the property.

Having regard to the said submission, this Writ Petition is disposed of, directing that the respondent-Municipal Corporation shall not take any coercive action against the petitioners for alleged illegal constructions made without following the due process. If the petitioners have any grievance alleging illegal interference other than taking coercive action on the illegal constructions, they shall have to work out their civil remedies as available in law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
