THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.16496 OF 2017 ORDER:
The grievance of the petitioner is that the respondent - authorities, having issued licence, have not yet issued permit to run A4 shop, bearing GSL No.68, Rajampet, Kadapa District. Heard the learned counsel for the petitioner. Learned Government Pleader for Prohibition and Excise (AP) submits that the petitioner has not specified the premises where he desires to establish the shop so as to enable the Excise Officials to verify whether the location of premises is in conformity with Rule 25 of the A.P. Excise (Grant of Licence of Selling by Shop and Conditions of Licence) Rules, 2012 (the Rules).
In the facts and circumstances of the case, the grievance of the petitioner can be redressed by giving liberty to specifically identify the place where he desires to establish A4 shop in conformity with Rule 25 of the Rules, and also the judgment of the Supreme Court, as has been mentioned in the licence granted in his favour. As and when such application is made by the petitioner, respondent No.4 shall verify whether the premises, identified by the petitioner, is in conformity with the parameters laid down under Rule 25 of the Rules, and other parameters required in law, and grant permit to enable him to commence business. As the petitioner had already paid licence fee, and is expected to commence business from 01.04.2017, the
entire exercise shall be completed within a period of two weeks from the date of receipt of a copy of the order. The Writ Petition is disposed of accordingly. No costs. Miscellaneous petitions pending, if any, shall stand closed.
