HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.P.No.13636 of 2015 & W.A.No.449 of 2015 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

Mr.V.Venugopala Rao, learned counsel appearing for respondent No.1, who was petitioner in W.P.No.13636 of 2015, seeks liberty to withdraw the said writ petition and the pending miscellaneous petitions, if any. This writ appeal is arising from the order dated 01.05.2015 passed in W.P.M.P.No.17898 of 2015 in W.P.No.13636 of 2015. Learned counsel appearing for the appellant has no objection for allowing the 1st respondent (petitioner in W.P.No.13636 of 2015) to withdraw the writ petition itself. In view of the submissions of the learned counsel for the parties, the writ petition is disposed of as withdrawn and as consequence thereof the impugned order stands set aside. Consequently all the miscellaneous petitions in writ petition also stand disposed of.

In view of withdrawal of the writ petition, nothing survives in the instant writ appeal and it is disposed of as such.

At this stage, learned counsel appearing for respondent No.1 seeks liberty to respondent No.1 to file an application for appropriate relief in the proceedings under

Section 87 of the A.P. Charitable and Hindu Religious Institutions and Endowments Act, 1987 (Act 30/1987). The Original Application filed by respondent No.1 before the A.P. State Endowments Tribunal under Section 87 of the Act is pending. In the Original Application, respondent No.1 has already filed an application for injunction which, we are informed, is pending. Keeping that in view, it is always open to respondent No.1 to file application for any other appropriate relief, if law so permits. If any such application is filed, the same shall be considered strictly in accordance with law.

Consequently, miscellaneous petitions, if any pending, also stand disposed of.
