THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CRIMINAL PETITION No. 15492 OF 2016 ORDER:
Vide the present petition, the petitioners seek anticipatory bail in crime No. 24 of 2011 registered at Tekkali Police Station, Srikakulam District, for the offence punishable under Sections 420, 120-B, 406, 407, 468 and 471 read with Section 34 of the Indian Penal Code. Learned Additional Public Prosecutor, on instructions, submits that the petitioners are not added as accused in the crime mentioned above. Therefore, the present petition is not maintainable. Keeping in view the statement made by learned Additional Public Prosecutor, the present petition is not maintainable. However, direction is issued to the investigating agency that if, at the subsequent time, they come to the conclusion that petitioners have played role, a notice for ten days shall be issued to the petitioners before their arrest in writing.
