HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.32573 OF 2014 ORDER:
The petitioner prays for Mandamus declaring the action of the 2nd respondent in passing the impugned orders No.B/648/2010 dated 14.08.2014, as illegal and unconstitutional and consequential direction to the respondents not to dispossess the petitioner from the petition property.
The petitioner is running a textile business under the name and style of "Sajni Textiles & Readymade Garments" in a rented premises bearing No.6-3-848 (petition property), opposite to Seesh Mahal Theatre, Ameerpet, Hyderabad. The grievance of the petitioner is that the 2nd respondent without issuing notice calling for objections to the petitioner under Section 5-A of the Land Acquisition Act, passed impugned orders dated 14.08.2014 for acquiring a portion of the petition property admeasuring 17.15 square yards for the purpose of road widening for Metro Rail Corridor-III from Greenland Junction to Ameerpet Junction.
Heard learned counsel for the petitioner and the learned Government Pleader.
The petitioner claims to be tenant of subject premises. The petitioner objects to the land acquisition proceedings initiated by the 3rd and 4th respondents for widening the road. The petitioner even assuming to be the tenant of the premises has not made out any legal ground to challenge the impugned proceedings. The landlord apparently is participating in the ongoing land acquisition proceedings. The petitioner if has a right, can establish his status as a tenant and his rights are to be considered at a different stage in the land acquisition proceedings within four corners of law. The writ petition fails and accordingly dismissed. No order as to costs.
