Heard learned counsel for the petitioners/accused in crime No.124 of 2017 of Suryapet II Town Police Station, Suryapet District, registered for the offence under Sections 420 & 379 IPC and also learned Public Prosecutor representing the 1st respondent/State and before ordering notice to the 2nd respondent-defacto complainant.

Leave about the several contentions raised in the petition left open for the future defence of the petitioners, there is nothing at this stage to interdict the investigation.

Having regard to the above, the Criminal Petition itself is disposed of by making it clear in the event of necessity of arrest of any of the petitioners, the police strictly to follow Section 41-A Cr.P.C. and guidelines of the expression of the Apex Court in Arnesh Kumar Vs. State of Bihar1.
