HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Crl.P. No.8664 OF 2018 ORDER:

This criminal petition is filed under Section 482 Cr.P.C. by the petitioners/accused to quash the proceedings Crime No.213 of 2018 of Sankerpalli Police Station, Cyberabad, registered for the offences punishable under Sections 406 and 420 IPC and Section 5 of the Telangana State Protection of Depositors Financial Establishment Act and 76 of the Chit Funds Act.

During hearing, learned counsel for the petitioners requested this Court to extent benefit of Section 220 Cr.P.C., without touching the merits in the grounds urged.

The case is at the stage of crime and charge sheet is not yet filed. If for any reason, separate charge sheet is filed against the petitioners, the petitioners are entitled to benefit under Section 220 Cr.P.C. Keeping in view of Section 220 Cr.P.C., the investigating agency is directed to proceed further.

With the above direction, the criminal petition is disposed of. Pending miscellaneous petitions in the petition, if any, shall stand closed.
