HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.29241 of 2018 ORDER :

Heard Sri B.Parameswara Rao, learned counsel for the petitioner and Sri N.Praveen Kumar, learned Standing Counsel for respondent-Municipality.

Earlier, respondent Nos.3 and 4 herein filed W.P.No.43478 of 2017 before this Court and this Court disposed of the said writ petition on 26.12.2017. The operative portion of the said order reads as under: Having regard to the facts and submission, the Writ Petition is disposed of direction respondent No.2 Municipality to consider and dispose of the representation, dated 29.11.2017, of the petitioners, received by it on 01.12.2017, in strict accordance with the procedure established by law, however, within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken thereon to the petitioners within a week thereafter."

It is submitted by the learned counsel for the petitioner that though the petitioner herein submitted representations on 14.05.2018 and 22.12.2016 before the 2nd respondent with regard to the subject property, the respondent-municipal authorities are not considering the same.

It is further submitted by the learned counsel that in respect of the subject matter, O.S.No.22 of 2017 is pending on the file of the II Additional District Judge, Asifabad, and the municipal authorities are

trying to proceed with the matter without hearing the petitioner herein, therefore, the petitioner would suffer irreparable loss. 5.

Having regard to the submissions of the learned counsel for the petitioner and learned Standing Counsel, this Court deems it appropriate to dispose of the writ petition, without expressing any opinion on the merits of the case, with a direction to the 2nd respondent to consider the representations, dated 14.05.2018 and 22.12.2016, said to have been submitted by the petitioner herein, and pass appropriate orders in accordance with law. 6.

Accordingly, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. No costs.
