Order :

This Writ Petition is filed for a Mandamus to declare the action of the respondent, in not releasing building permission to the petitioners in respect of their property admeasuring 5396.6

square yards in Survey No.153/3 of Paradesipalem Village, Chinnagadali Mandal, Visakhapatnam Rural, as illegal and arbitrary.

At the hearing, Mr.S.Lakshminarayana Reddy, learned Standing Counsel for the respondent- Corporation, on instructions, submitted that the petitioners' application for building permission was returned by the respondent on 29.09.2015. He has also furnished a copy of the proceeding, by which the petitioners' application was returned, to the learned Counsel appearing for them.

In view of this subsequent event, the Writ Petition as conceived has become infructuous and the same is disposed of as such. However, if the petitioners feel aggrieved by the rejection of their application, they shall be free to avail appropriate remedy in accordance with law.

As a sequel to disposal of the Writ Petition, WPMP.No.36338 of 2015, filed by the petitioners for interim relief, is disposed of as infructuous.
