HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.19673 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Standing Counsel for the respondents. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner states that he has property bearing D.Nos.41-939 to 4-1-946, Tilak Road, Abids, Hyderabad, which is his ancestral property. While so, when the respondents are trying to erect transformer in front of his property, the petitioner made a representation dated 18.06.2015 to the respondents. The respondents, without considering the said representation, are going ahead with the erection of transformer. Hence the Writ Petition.

Learned Standing Counsel for the respondents, on instructions, submits that the transformer is not being erected in front of the petitioner's property but at an adjacent place without obstructing ingress and egress to the petitioner. Learned Counsel for the petitioner denies the same and submits that the representation of the petitioner dated 18.06.2015 may be considered and, as the petitioner had shown an alternative site for erection of transformer, the respondents may consider the said place.

This Court is not inclined to keep the Writ Petition pending in view of the statement of the learned Standing Counsel for the respondents that the transformer is not being erected in front of the petitioner's property but at an adjacent place. The respondents are directed to consider the representation of the petitioner dated 18.06.2015, and also consider the feasibility of locating it at a place shown by the petitioner.

The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. No order as to costs _______________________________ A. RAMALINGESWARA RAO,J Date: 02.07.2015 usd
