THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.20324 of 2010 ORDER:
The petitioner invoked the jurisdiction of this Court questioning the action of the respondents in not promoting him as a Chief Engineer merely on the ground that the person senior to him had not been promoted as he was involved in a vigilance case. By way of an interim order dated 30.08.2010, this Court directed the respondents to consider the case of the petitioner for promotion as Chief Engineer against the vacancy which arose on 31.07.2010, and as recommended by the Departmental Promotion Committee. Sri Siva, learned counsel for the petitioner, states that the petitioner was considered for promotion; he was promoted as Chief Engineer by proceedings dated 30.08.2010; and he retired on the very next day i.e 31.08.2010.
It is evident, therefore, that the cause in the writ petition does not survive; and the Writ Petition has become infructuous. The Writ Petition is, accordingly, dismissed as infructuous. Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
