THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.18839 OF 2015 ORDER:

This writ petition is filed seeking to declare the action of the 2nd respondent in passing orders from time to time enabling the 3rd respondent to continue the 4th respondent as Chief Engineer on contract basis, as illegal and arbitrary, and consequently, to direct the 2nd respondent to appoint a suitable candidate in the post of Chief Engineer in the place of the 4th respondent.

On 1.7.2015, while issuing notice before admission, this Court passed interim order directing the 2nd respondent to take steps for filling up of the post of the Chief Engineer for respondent No.3 on permanent basis or by promotion, within a period of three months from that day. 3.
Today, when this matter was taken up, the learned Counsel for the petitioners submitted that in pursuance of the interlocutory order passed by this Court on 1.7.2015, the Chief Engineer was appointed and therefore, cause in the writ petition does not survive.

Recording the above submission, the Writ Petition is dismissed as infructuous. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
