THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.14563 of 2005 ORDER:
This writ petition was filed assailing the proceedings dated 30.05.2005 issued by the Depot Manager, Andhra Pradesh State Road Transport Corporation (APSRTC), Kamareddy.
The case of the petitioner was that though he was offered alternative employment as a Shramik owing to his defective vision which rendered him unfit to continue in the post of Driver, the APSRTC was dragging its feet. He stated that he had submitted his willingness for such alternative employment under letter dated 01.06.2005 but his case was not being considered, in violation of the spirit of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.
By order dated 06.07.2005, this Court directed the APSRTC to continue the petitioner in employment duly paying him wages till suitable alternative employment is provided.
Sri N. Praveen Reddy, learned counsel representing Sri N. Vasudeva Reddy, learned Standing Counsel for the Telangana State Road Transport Corporation, the successor-in-interest of the APSRTC in the State of Telangana, states on instructions that the petitioner was provided alternative employment after the passing of the interim order and expired thereafter while in service.
In that view of the matter, the prayer in the writ petition has worked itself out. However, in the event any grievance remains in the context of the alternative employment offered to the petitioner, which was duly accepted by him, the same is left open for being canvassed before the appropriate forum in accordance with law, if the cause still survives.
The writ petition is accordingly closed subject to the above observation. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
