HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10367 of 2015 ORDER:

This petition is filed for issuance of a writ of Mandamus declaring the inaction of the respondents in not putting the building, which is constructed with the public funds in the open place allotted admeasuring 2,394 sq.mtrs in L.P.No.70/82 in T.S.No.81 in Chilakaluripet town within the limits of 2nd respondent Municipality, to use, as arbitrary, illegal and violative of principles of natural justice.

2. The case of the petitioner is that he is a member of 3rd respondentChilakaluripeta Muslim Shadikhana Committee. The 2nd respondent-Chilakaluripeta Municipality allotted site of 2394 sq.mtrs. on lease basis for a period of 25 years vide its resolution dated 30.09.2002 to Muslim community for the purpose of construction of Shadikhana and G.O.Ms.No.417 MA (J1) dated 06.09.2003 was also issued to that effect and the Public Works Department also constructed a building therein but the same was not put to use. Though, the petitioner approached the respondents to take steps for using the said building, no steps have been taken by the respondents. Aggrieved by the same, the present writ petition is filed.

3. Heard the learned counsel for the petitioner, Government Pleader for Municipal Administration, appearing for respondent No.1 and Sri N.Venkateswarlu, learned Standing Counsel appearing for respondent No.2.

4. Learned Standing Counsel for respondent No.2 states that the said building is under repairs and after repairs are affected, the same will be put to use and it may take some time.

5. In view of the said submission, respondent No.2 is directed to complete the repairs of the said building within three months from the date of receipt of a copy of this order and the same to be used for intended public purpose.

6. With the above direction, this Writ Petition is disposed of. No costs.
