THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20008 of 2016 ORDER:
The petitioner is the fair price shop dealer of Shop No. 28 of Dammalapadu Village, Muppalla Mandal, Guntur District. Her authorization was cancelled vide proceedings dated 04.04.2016 of the 3rd respondent Revenue Divisional Officer, Guntur. The petitioner availed the remedy of Appeal before the 2nd respondent Joint Collector. A stay Application has also been moved therein, but so far, no orders have been passed thereon is the complaint of the petitioner. Learned counsel for the petitioner contends that without considering the explanation submitted by the petitioner to the show cause notice dated 01.07.2015, the impugned order came to be passed.
Be that as it may, since the petitioner has already preferred the Appeal along with an Application for stay, there is no necessity for this Court to go into the details of the matter. Suffice it to direct the 2nd respondent Joint Collector to consider and pass appropriate final orders on the Appeal so preferred by the petitioner, after considering her explanation and after following the principles of natural justice, within four weeks from the date of receipt of a copy of this order. Ordered accordingly. Pending consideration of the Appeal, the order of cancellation shall stand suspended.
With this order, the Writ Petition stands disposed of. No costs. Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
