THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.42262 OF 2015 ORDER:

In this Writ Petition, the petitioner has questioned the proceedings dated 17.12.2015 of the 2nd respondent suspending the petitioner's Fair Price Shop Dealership authorization. The impugned order indicates that there was variation in PDS rice to the extent of 485 kgs. If the said allegation is true, it is clear that this is beyond the permissible limit under the Andhra Pradesh State Public Distribution System (Control) Order, 2008.

2. Learned Government Pleader for Civil Supplies states that a show cause notice is also being issued on 17.12.2015 and handedover copy of the said show-cause notice to counsel for the petitioner.

3. Although counsel for the petitioner disputed the contents of the said show-cause notice, I am of the opinion that this is a matter to be enquired into as per the above Control Order. Therefore, the 2nd respondent is directed to complete the enquiry as per Sub Clause (5) of Clause 5 of the Andhra Pradesh State Public Distribution System (Control) Order, 2008, within 90 days from the date of serving of showcause notice to the petitioner, after complying with the principles of natural justice and providing a personal hearing to the petitioner.

4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
