Mr. Ashish Changavalli, learned Advocate Commissioner. I.A.No.1 of 2026 in C.C. No.2848 of 2025 The instant application has been filed by the Advocate Commissioner seeking for the following two reliefs:-
1) To increase the fees of the Advocate Commissioner; and
2) Direct the parties to pay the unpaid part of the fees.
The matter as of now is seized in mediation before the Hon'ble Supreme Court and a retired Judge of the Hon'ble Supreme Court is appointed as a Mediator. Therefore, at this juncture it would not be appropriate to modify the earlier terms and conditions so far as the fees fixed for the Advocate Commissioner is concerned. Nonetheless, there can be no dispute so far as the entitlement of the fees of the
Advocate Commissioner for the days that he has visited the venue fixed for visitation.
Learned counsel appearing on either side have fairly conceded that if at all if there is any fees that is not paid for the dates on which the Advocate Commissioner has visited the venue fixed for visitation, it shall be honoured forthwith without any further delay.
At this juncture this Court is not inclined to give a rise in the fees of the Advocate Commissioner that has been sought for, for the simple reason that the matter is seized before the Hon'ble Supreme Court and any order modifying would amount to recalling an earlier order of this Court which is under challenge before the Hon'ble Supreme Court.
