Smt. K. Sujatha, v. The Debts Recovery Tribunal-I,
HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE MS. JUSTICE J. UMA DEVI WRIT PETITION NO.27043 OF 2017 ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) The order under challenge in this Writ Petition is the order passed by the Debt Recovery Tribunal - I, Hyderabad in S.A. No.286 of 2016 dated 28.07.2017. The petitioner has an effective alternative remedy of an appeal, under Section 18 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, to the Debt Recovery Appellate Tribunal. We see no reason, therefore, to exercise discretion to entertain this Writ Petition. Leaving it open to the petitioner to avail the statutory remedy of appeal, the Writ Petition fails and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. No costs. _________________________________ (RAMESH RANGANATHAN, ACJ) _________________ (J. UMA DEVI, J) Date: 16-08-2017.
