THE HON'BLE SRI JUSTICE S.V.BHATT W.P. No.2953 of 2017 ORDER:

The petitioners complain against the inaction in considering and disposing of representation/application dated 19.12.2016 said to have been filed by petitioners under 3H(4) of the National Highways Act, 1956, as illegal, arbitrary and unconstitutional.

The learned Assistant Government Pleader referring to written instructions dated 22.03.2018 submits that the inaction alleged against the 4th respondent is illegal and unsustainable. According to him, respondent No.4 passed Award No.5/2016, dated 08.03.2016, and the application for determination of eligibility to receive compensation was made on 20.12.2016 to refer to Civil Court. The Assistant Government Pleader informs that in view of the interim order granted by this Court on 30.01.2017, the further steps in acquisition could not be taken up and the decision of the 4th respondent will be communicated to petitioners within two

(02) weeks from today.

The statement is placed on record and accepted. The writ petition is disposed of directing respondent No.4 to communicate decision said to have been taken on the

representation of all petitioners within two (02) weeks from today. The aggrieved parties can work out remedies in accordance with law. The Assistant Government Pleader is given liberty to communicate the order to respondents forthwith.

With the disposal of the writ petition, the interim order granted on 30.01.2017 stands vacated. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
