HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.7079 of 2013 ORDER:

This Writ Petition is filed questioning the action of the respondents in attempting to demolish the petitioners' property bearing No.8-1-207/88/3, admn. 1342 sq. yards, situated at Tata Nagar, R.R. District, pursuant to demolition order vide order No.G140/UC/ACP6/58/GHMC/2012, dated 2.3.2013. 2.

The case of the petitioners is that the order under Section 452 (2) of Hyderabad Municipal Corporation Act, 1955 has been issued without giving any details and that it is vague; an application under Section 452-A of Hyderabad Municipal Corporation Act, 1955 has been filed by the petitioners before the respondents and the respondents may be directed to consider the same.

The Standing Counsel for the respondents submits that the application of the petitioners filed under Section 455-A is pending with the respondents and they will consider and pass appropriate orders in accordance with law. 4.

In view of the submissions made by both the Counsel for the petitioners and the Standing Counsel for the respondents, this Writ Petition is disposed of directing the respondents to consider the application filed by the petitioners under Section 455-A, if it is not yet considered, and pass appropriate orders thereon in accordance with law. 5.
