Heard. With the consent of learned counsel for the parties, the Writ Petition is being disposed of at the stage of admission. 2.

The grievance of the petitioners is that the without following the procedure as required in law, the respondents are undertaking construction of a permanent Horticulture Market Yard in between their agricultural land and the road margin and the same is obstructing the ingress and egress of their property, which is ex facie illegal.

When the matter is taken up for consideration, learned Assistant Government Pleader for Roads and Buildings, on instructions, submits that the respondents would follow the due procedure as required in law before constructing the Horticulture Market Yard and in case the agricultural land of the petitioners is affected, necessary steps would be taken.

In view of the said submission, the Writ Petition is disposed of directing the respondents to follow the due procedure before constructing the Horticulture Market Yard and shall not cause any obstruction to the property of the petitioners without following due procedure. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
