HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.29163 OF 2018 ORDER:

The present writ petition came to be filed seeking to direct the 4th respondent to conduct the survey the property situated in Sy.Nos.263,274,278 and 269 of Thimmapur Haveli Village and Mandal, Warangal District, as per the notice issued by the Mandal Surveyor in File No.D226/2018 dated 20.2.2018.

The averments made in the writ affidavit show that the father of the petitioner was the absolute owner and possessor of the land admeasuring Ac.5.19 gts, situated at Sy.No.278/B of Thimmapur Haveli Village, Khila (Fort), Warangal District and after the demise of the father of the petitioner, the petitioner succeeded to the subject property. While things stood thus, when some land grabbers, with help of revenue authorities tried to grab the property of the petitioner, he requested the 4th respondent to conduct the survey of the subject land; fix boundaries and take necessary penal actions against the land grabbers. But, it is said that the 4th respondent failed to take any action. Thereafter, the petitioner gave a complaint to the 2nd respondent who in turn directed the Tahsildar to complete the survey before 24.6.2018.

Subsequently, Tahsildar, Khilla Warangal Mandal wrote a letter dated 19.7.2018 to the Assistant Director, Warangal Urban stating that the petitioner is not in a possession of the subject land and some third parties are in possession and that the question of demarcation of the subject land, would not arise.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioner to make a fresh application to the 4th respondent to conduct the survey of the subject property, enclosing documents evidencing their ownership over the property, within a period of two weeks from today and on such filing, the 4th

respondent shall take steps to conduct the survey of the subject land and communicate the same to the petitioner, within a period of two weeks thereafter.

With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
